1. Scope and Consent

1.1. Personal data of natural persons – users of the website https://novaposhtaglobal.ua are processed by NOVA POSHTA GLOBAL LIMITED LIABILITY COMPANY, a legal entity registered under the laws of Ukraine, located at: 103 Stolychne Highway, Kyiv, Ukraine, 03026 (hereinafter – the Company or NP Global ). The Company is the controller of the Personal Data of users of the https://novaposhtaglobal.ua website.

1.2. This Privacy Policy describes the procedure established by the Company for processing personal data collected using the https://novaposhtaglobal.ua website (hereinafter – the Site), and related services and tools that allow users to register on the Site, and use related services. In all specified cases, the Company processes users’ personal data exclusively within the framework of the requirements of Regulation (EU) 2016/679 (GDPR).

1.3. By using the Site and/or other related services and tools of the Company, the User confirms that in order to carry out the Company’s business activities and offer the Company’s services, the User has given their consent to the Company’s processing of personal data (hereinafter – Personal Data), information concerning them:

– surname, first name, patronymic;
– contact phone numbers;
– postal address;
– e-mail.

1.4. Personal data processed by the Company is classified as confidential information.

2. Information collected, received, and stored by the Company

2.1. Registration information: when the User creates an account on the Site, the Company may request the information listed in clause 1.3 of this Policy.

2.2. During the Site’s operation, the Company may collect personal information about users’ participation in marketing campaigns organized on the Site. During the operation of the Site, the Company may also process information related to the effectiveness of advertising campaigns, including views of advertisements on the Site.

2.3. Customer service: When Users contact the customer support department, the Company, if necessary, may, in the course of its Website, collect personal information necessary to fulfill the User’s request and receive feedback. The Company may also contact the User using the existing account contact information provided for this purpose. The Company may also collect other information about communication with Users, such as any inquiries to the customer support department submitted by Users or any feedback provided by them.

2.4. The Company may collect and store information obtained as a result of surveys that may be conducted by the Company or contractors engaged by the Company – third parties.

Information that the Company does not collect and does not process:

The company does not collect or process personal data about racial or ethnic origin, political, religious, or ideological beliefs, membership in political parties and trade unions, and similar information.

3. Cookies

3.1. During the operation of the Site, the Company may collect certain information using such technologies as cookies.

3.2. With the help of cookies, the web server can save, for example, preferences and settings on the User’s computer, mobile phone, or other device(s), which are then automatically restored at the next visit. In other words, cookie files are intended to make the use of the Site more convenient, for example, so that the User does not have to repeat the process of logging in to the system during the next visit. The company uses both permanent and session cookies. Permanent cookies remain on the User’s computer for a longer period, and session cookies are automatically deleted when the browser window is closed.

4. Use of personal data

4.1. To provide its services, the Company may use the information that the Company collects and places for the following purposes:

4.1.1. providing customer service, including creating and managing user accounts, solving technical difficulties, and accessing various functions;

4.1.2. adaptation of offers and experiences, including advertising on its services or services of third parties;

4.1.3. control of general and individual user activity to manage traffic on the Site;

4.1.4. communication with users, including for service, customer service, or permitted marketing communications through any available communication channels;

4.1.5. carrying out research and analytical activities in order to improve our service; 

4.1.6. ensuring compliance with the Agreement with users of the Company’s services, taking into account the fight against fraud and insults;

4.1.7. evaluating certain factors of personal information, in particular, to analyze and predict personal preferences, interests, behavior, and location.

4.2. The Company may retain the information it collects and receives on its Site for as long as necessary to fulfill the above business purposes.

5. Exchange of information

5.1. The Company may use third-party service providers to provide some components of its services. In such cases, the providers are not authorized to use the personal data obtained through the Company’s Site, other than to provide the Company’s services, and the personal data itself is the subject of this Privacy Policy.

5.2. The company reserves the right, under the requirements of the law, to provide information to state bodies for the following purposes:

– fight against fraud and abuse on the Site;
– investigating violations of the current legislation of Ukraine or fighting against any other violations of the provisions of the Public Accession Agreement and the Terms of Service of NOVA POSHTA Global.

5.3. The company may provide personal data of users at the request of competent state authorities, issued under the requirements of current legislation.

6. User control

6.1. Access, Correction, and Removal: Users who have created an account on the Site may access, correct, or delete the information they provide. The user is responsible for the accuracy of the provided data or messages on the Site. Users can change the information they post in their personal accounts only by themselves. The Company may delete or stop processing the User’s personal data upon receipt of the User’s written notice of withdrawal of consent to the processing of personal data.

6.2. Cookies: Most desktop and mobile web browsers (e.g. Safari, Firefox, Internet Explorer, Chrome, Opera) provide controls that allow users to limit or block the installation of Cookies on their systems. Please note that disabling cookies for domains of the first category (visited sites) and other domains (sites related to visited sites) may lead to limited functionality of the Site in some cases.

7. Security

All information we collect is reasonably protected by security measures and procedures to prevent unauthorized access or use of the data. Persons affiliated with the Company, trusted partners and independent service providers undertake to use the information received from the Company in accordance with requirements and this Privacy Policy.

8. User’s rights

The User has the right to:

1) to know about the sources of collection, the location of their personal data, the purpose of its processing, the location or place of residence (residence) of the controller or operator of personal data or to give an appropriate order to obtain this information to persons authorized by them, except for cases established by law;

2) receive information about the conditions for granting access to personal data, in particular, information about third parties to whom their personal data is transferred;

3) access their personal data;

4) to receive no later than thirty calendar days from the date of receipt of the request, except in cases provided by law, an answer on whether their personal data is being processed, as well as to receive the content of such personal data;

5) present a reasoned request to the personal data controller with an objection to the processing of their personal data;

6) make a reasoned request to change or delete their personal data by any personal data controller and operator if these data are processed illegally or are unreliable;

7) to protect their personal data from illegal processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of data, as well as protection from providing information that is unreliable or disgraces honor, dignity, and business reputation of the natural person;

8) file complaints about the processing of their personal data to the competent supervisory body to the court;

9) apply legal remedies in case of violation of the legislation on the protection of personal data;

10) enter a reservation regarding the limitation of the right to process their personal data when giving consent.

9. How we keep your personal data secure

9.1. We use technical and organizational security measures, including encryption and authentication tools, to protect your personal data from manipulation, loss, destruction, and unauthorized access by third parties.

9.2. Although the transmission of data over the Internet or website cannot be guaranteed to be secure, together with our business partners, we make every effort to provide physical, electronic, and procedural safeguards for your information under applicable data protection requirements.

Examples of our security measures include:
– Strictly limited access to your data on a “need to know” basis and only for relevant purposes;
– Data transfer only in encrypted form;
– Storage of confidential data in encrypted form;
– IT systems are technically isolated from other systems and housed in secure data centers to prevent unauthorized access;
– Monitoring of IT systems to detect and stop improper use of personal data.

9.3. Please remember that if you have a personal password that allows you to access certain parts of our websites or any other portal, application, or service we use, you are responsible for keeping that password confidential. We ask that you do not share your password with anyone.

10. How long we keep your personal data

10.1. We retain your personal data only for as long as necessary for the purpose for which we obtained it and for any other permitted purposes. If the information is used for two purposes, we will keep it until the longest period expires. We will stop using the data for the purpose with the shorter period when that period ends.

10.2. We limit access to your data only to those persons who need to use it for relevant purposes.

10.3. Our retention periods are based on business needs, and your personal data that is no longer needed is either irreversibly anonymized (depersonalized) or securely destroyed.

11. Data processing outside the EEA

11.1. Nova Poshta Global LLC conducts its economic activities in many corners of the world. Your personal data may be accessed by our employees or our carefully selected agents or contractors from a country outside the European Economic Area (EEA) for any of the purposes set out in this policy. These countries may have data protection laws that may be of a lower standard than in the EEA. We guarantee that any of your data accessed outside the EEA will be processed subject to appropriate safeguards.

11.2. Some countries outside the EEA, such as Canada and Switzerland, have been approved by the European Commission as providing substantially equivalent protection to EEAS personal data protection laws, and therefore no additional legal safeguards are required. In countries where such approval has not been granted, we will either ask for your consent to the transfer or transfer personal data under contractual terms approved by the European Commission that impose equivalent personal data protection obligations directly on the data importer, unless there is a prohibition on taking appropriate actions under the current legislation on the protection of personal data.

12 . Changes to this Policy

12.1. This Privacy Policy was last updated on 27.07.2022. The Company may update this Privacy Policy from time to time; a new version of the Privacy Policy shall be effective from the moment it is posted on the Internet at the address specified in this paragraph. 

12.2. If the Company has made any changes to the Privacy Policy, with which the User does not agree, they must stop using the Site’s services. The fact of continued use of the Site is confirmation of the User’s consent and acceptance of the relevant version of the Privacy Policy.
